Terms of Service:

KW Laundry Services LLC, its employees, agents, and contractors (“KW Laundry Services LLC:) are is pleased to provide professional pick-up and delivery laundry services to our customers and offers quality and convenience at an affordable price. We offer you, our customers, our services subject to your compliance with and acceptance of the terms and conditions stated and set forth below. Your use of KW Laundry Services LLC services (“Services”) indicates your agreement to be bound by the terms and conditions contained herein. Please read the following provisions carefully and if you do not so agree, you should inform us and cease using the Sservices immediately. This agreement is strictly between KW Laundry Services LLC, its customers and services provided by parties subcontracted by KW Laundry Services LLC, and does not in any way constitute or imply any relationship with any other parties.

Pick-up/Delivery Schedule:

Pick-up/Delivery will take place on a pre-determined day and frequency, except on certain holidays as determined by the service provider. KW Laundry Services LLC. reserves the right to determine the pick-up/delivery times and reschedule pick-up/delivery times upon prior notice to its customers.

Pick-up and Delivery, Procedure and Terms:

KW Laundry Services LLC will provide each customer with a Laundry Care nylon/polyurethane/canvas laundry bag. KW Laundry Services LLC reserves the right not to pick-up items that are not in these bags. Weekly customers are provided a free Laundry Care bag(s) at the beginning of their service plan. A fee of $4 per bag will be charged to the customer for replacement bags.

The customer agrees not to include any of the following items inside their wash and fold laundry bag given to KW Laundry Services LLC representatives for service: (i) non-washable items, (ii) items that are labeled for hand washing and/or dry cleaning only, or (iii) any other items not meant for laundering.
The customer is responsible for any and all damage caused by any items left in the customer’s clothing or laundry bag that causes damage to the clothing of any customer, the cleaning machines, or any other property of KW Laundry Services LLC or its other parties or customers.
KW Laundry Services LLC and its subcontractors are not responsible for, and shall not pay for, any loss, damage or theft of items left unattended by the customer for pick-up or delivery. KW Laundry Services LLC will not leave items in the possesion of any other person that is not the owner of those items unless the owner has given prior consent. The customer is responsible for ensuring that his/her KW Laundry Services LLCLaundry Care laundry bag is in the possession of a KW Laundry Services LLC representative.

Missed/Unattended Pick-up or Delivery:

If the customer misses the scheduled pick-up during any given week, the customer will forfeit the service for that week and will not be reimbursed. If the customer misses a scheduled delivery, the customer must coordinate with KW Laundry Services LLC to reschedule the delivery during the next available delivery time.

Payment:
The customer must pay the agreed upon charges prior to service. Service will not begin until KW Laundry Services LLC has received payment in full. Services that have been paid for but go unused do not carry over from week to week or from service term to service term. All online payments are made through KW Laundry Service’s secured payment system or as an ACH debit directly from their checking account via KW Laundry Services invoice. KW Laundry Services LLC does not accept cash but does accept bank checks or cashier checks mailed directly to the Accounting Department. Contact us at kwlaundryservices@gmail.com if you wish to coordinate such a payment. KW Laundry Services LLC reserves the right to change prices at any time.
Weekly use customers are required to provide credit card information that will be stored securely by KW Laundry Services LLC third party credit card processor. If additional services outside of the customer’s purchased weekly serivce plan are requested, said credit card will be charged the fee for these services.

Refunds:

Except as described in this paragraph, all sales are final and all payments are non-refundable. A customer who has signed up for a prepaid package plan will have the right to cancel his or her contract within fourteen (14) days of signing up for the KW Laundry Services LLC service and receive a full refund if no promotional item was received. After such fourteen day period, KW Laundry Services LLC shall have no obligation to refund any amounts paid by the customer. If a promotional item was received the sale is final and the payment is non-refundable.

Inventory Sheets:
Inventory sheets are available per request that should be filled out by the customer. While not required, we request that you fill out these sheets so that there is never any discrepancy to the items in your bag. You will be notified immediately of any discrepancy that is discovered. We will not proceed with washing without resolving said discrepancy with you. All information provided on the inventory sheets by the customer shall be accurate in every way. KW Laundry Services LLC is not responsible for any items not listed on the inventory sheets. KW Laundry Services LLC reserves the right to complete an inventory sheet for customer’s who have not provided one themselves based on the items inside the customer’s bag without notice to the customer.

Garment Care:

KW Laundry Services LLC will use reasonable efforts to maintain a high quality cleaning service. KW Laundry Services LLC and its subcontractors accept no liability for damage due to normal cleaning of items without care instructions, or for dry clean items placed inside wash and fold bags. KW Laundry Services will follow any reasonable instructions provided, including as to water or drying temperature. However, KW Laundry Services LLC does not read cleaning instruction labels of clothes submitted because of the low prices charged. Accordingly, KW Laundry Services LLC and its subcontractors accept no liability for special care items that require special attention, including dry clean only items. KW Laundry Services LLC is not responsible for clothing bleeding, shrinking, or otherwise changing as a result of normal washing procedures. Precautions will be taken to alleviate these problems if possible. KW Laundry Services LLC and its subcontractors reserve the right to refuse to clean any garment. KW Laundry Services LLC and its subcontractors do not guarantee the removal of all stains. KW Laundry Services LLC will re-clean items that, in its sole discretion, were not properly cleaned and have not been worn since they were cleaned, at no additional cost. KW Laundry Services LLC and its subcontractors are not responsible for loss of or damage to any personal or non-cleanable items left in the clothing or laundry bags such as money, jewelry, or any other item. The customer agrees not to leave such items in their clothing or in their laundry bags. Zippers behave unpredictably while cleaning. Although zippers generally are not an issue, the client is notified that there is a possibility of zipper issues while following normal wash procedures, and KW Laundry Services LLC does not accept any liability for such issues.

Loss or Damage:

Missing or damaged items must be reported to KW Laundry Services LLC within 24 hours of delivery of your laundry bag. Failure to report the missing or damaged item within 24 hours shall remove any liability of KW Laundry Services LLC for the missing or damaged item. In the event that any item is lost or damaged by KW Laundry Services LLC, KW Laundry Services LLC will issue the customer a refund or credit for the value of that item as stated in this paragraph. If a customer is able to provide proof of purchase and purchase amount of the lost or damaged item, KW Laundry Services LLC will provide a full refund, notwithstanding a maximum reimbursement for each individual item of $100, and the maximum total reimbursement per customer of $200. If a customer is unable to provide proof of purchase, KW Laundry Services LLC will issue the customer a refund or credit for the value of that item as specified in the National Fair Claims Guide from the International Fabricare Institute (“IFI”). This guide takes into account the average life of the garment, depreciation for the age of the item, and the current replacement cost. If the customer is unable to document the age of a garment, KW Laundry Services LLC reserves the right to limit the maximum age of any garment to one year. If no current replacement cost is available KW Laundry Services LLC reserves the right to use the replacement cost of a comparable item currently available. KW Laundry Services LLC and its subcontractors are not liable for any preexisting damage to any garments or other items and reserves the right to return any item without cleaning it if any preexisting damage is found or if we have a concern about the colorfastness or the age or weakness of the fabric.

Confidentiality and Disclaimer:

KW Laundry Services LLC takes privacy and personal information seriously. KW Laundry Services LLC uses the information collected to fulfill your requests for certain products and services, to process payment transactions and facilitate billing, and to otherwise deliver services. We also may send merchant service announcements, newsletters, and periodic notices about specials and new products. KW Laundry Services LLC protects your personal information from disclosure except as used as stated herein, or 1) where we you’re your consent to share the information; 2) we need to share your information with third parties to provide the product or service you requested; 3) where appropriate to comply with the law; and 4) where it is necessary to enforce or apply the Terms of Use or the rights, property, or safety of KW Laundry Services LLC, or others. KW Laundry Services LLC’s liability shall be limited to general money damages in a maximum amount not to exceed the charges for the term of service paid by the customer during the term in which the damages are alleged to have occurred. This liability shall be the extent of KW Laundry Services LLC’s liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute the customer’s exclusive remedy. KW Laundry Services LLC disclaims all warranties, express or implied, with respect to the services rendered to the customer. UNDER NO CIRCUMSTANCES SHALL KW LAUNDRY SERVICES LLC BE LIABLE TO CLIENT OR ANY THIRD PARTY FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING FROM THIS AGREEMENT, SUCH AS, BUT NOT LIMITED TO, LOSS OF REVENUE OR ANTICIPATED PROFITS OR LOST BUSINESS, COSTS OF DELAY, PERSONAL OR PROPERTY DAMAGE, OR LIABILITIES TO THIRD PARTIES ARISING FROM ANY SOURCE.

Miscellaneous:

Upon Client’s authorization to commence work, the terms of this Agreement shall be binding upon parties. This Agreement constitutes the entire understanding between the parties and supersedes any other prior understandings or agreements, written or oral, between the parties; its terms can be modified or waived only by a written amendment to this Agreement, signed by both parties, and no course of conduct, failure or delay shall affect the validity, binding effect or enforceability of this Agreement or be considered an implied waiver. This Agreement shall be governed in all respects by the laws of the State of New York. The parties hereto hereby consent to the jurisdiction of the courts of the State of New York in Westchester County and each party waives all objections to convenience of forum. Neither Client nor KW Laundry Services LLC shall be liable to the other for any failure or delay in its performance due to any cause beyond its control, including acts of war, acts of God, earthquake, riot, sabotage, labor shortage or dispute, Internet interruption, government acts, and other similar events. KW Laundry Services LLC shall be entitled to reimbursement for its expenses, including court costs, and reasonable attorney’s fees, expenses and cost in any action against Client. Each provision of this Agreement shall be interpreted in such manner to be effective and valid under any applicable law, but if any provision is held to be invalid, illegal or unenforceable, then such provision shall be reformed, construed and enforced as if such provision had never been contained herein. KW Laundry Services LLC reserves the right to discontinue services at the discretion of its authorized agents or representatives. In such case, any pre-paid fees for which services have not been provided will be refunded to the client. Client consents to being photographed and filmed by KW Laundry Services LLC in connection with his/her use of services. Client further consents to KW Laundry Services LLC’s use of the photographs and films, including any performance, voice, or other aspect of Client’s persona, by KW Laundry Services LLC for any function or reason. In addition, Client assigns to KW Laundry Services LLC any copyright interest and right of publicity that may arise as a result of such filming or photography. This permission continues after a Client’s death, disability or termination of this Agreement. Client will not be given any additional compensation for KW Laundry Services LLC’s use of photographs or films.
